General terms and conditions governing the contractual relationship between Joyería Avalon and individuals who access, browse, or perform transactions through this website.

I. Acceptance and Purpose

Access to the Joyería Avalon website (hereinafter "the Site") and any purchase made through it imply full and unconditional acceptance of these General Terms and Conditions, as well as the Privacy Policy, Cookies Policy, and Store Policies (Returns, Cancellations, and Warranties).

Joyería Avalon (hereinafter "the Seller") reserves the right to modify these terms at any time. The applicable version shall be the one published on the Site at the time the transaction is conducted.

II. Product Description

Each piece is accompanied by a technical datasheet containing relevant commercial information, including: type of metal or alloy, approximate weight in grams, dimensions, available size (where applicable), and an indication that it is handcrafted jewelry with inherent variations resulting from the manual fabrication process.

Photographs published on the Site are for illustrative and editorial purposes. The Seller advises that minor differences in tone, texture, finish, or weight may exist in comparison with the physically delivered piece, without this constituting a product defect or a breach of contract.

III. Prices, Taxes, and Currency

All prices are expressed in Mexican Pesos (MXN). Unless explicitly stated otherwise, published prices include Value Added Tax (VAT) and other applicable taxes under current fiscal legislation in the United Mexican States. Shipping costs, if applicable, will be informed to the Buyer prior to order confirmation.

IV. Payment Method

All online payments are processed exclusively through Stripe, Inc., a global payment processing platform certified under the PCI-DSS Level 1 standard (the highest security certification level in the payment industry). The Seller accepts credit and debit cards (Visa, Mastercard, and networks supported by Stripe in Mexico).

The Seller declares that it does not store, retain, or have direct access to the Buyer's complete bank card details within its technological infrastructure. All sensitive financial information is managed entirely by Stripe under its own security and privacy policies, consultable at stripe.com/privacy.

Order confirmation is subject to charge approval by Stripe and the issuer of the card or payment method used. The Seller does not intervene in the bank authorization process.

V. Shipping and Delivery

Communicated delivery times are estimates and may vary based on product availability, customization processes, operational capacity, and courier company conditions. Geographic coverage, costs, and delivery times will be communicated to the Buyer during the purchasing process or via subsequent confirmation email.

Risk of loss or damage transfers to the Buyer upon effective delivery of the product by the courier service.

VI. Customized Orders and Size Selection

For pieces requiring size selection (such as rings and adjustable bracelets), the buyer is responsible for providing the correct measurement at the time of order placement. For custom-made or specially personalized orders, specific conditions of fabrication, delivery times, and return restrictions may apply, which will be communicated prior to order confirmation.

VII. Limitation of Liability

The Seller is responsible for the artisanal quality of its products and for reasonable order fulfillment in accordance with the published description and applicable law. The Seller shall not be held liable for:

  • Delays, losses, or damages attributable to transport or courier companies.
  • Force majeure or acts of God that prevent or delay fulfillment.
  • Errors in the data provided by the Buyer, including shipping address, size selection, or contact information.
  • Improper use of the product following delivery.

VIII. Intellectual Property

All designs, photographs, texts, logos, graphic elements, trademarks, and audiovisual content appearing on the Site are the property of the Seller or its legitimate owners, and are protected by applicable intellectual and industrial property laws. Any reproduction, distribution, public communication, or transformation, in whole or in part, is strictly prohibited without prior written authorization.

IX. Applicable Law and Jurisdiction

These Terms and Conditions are interpreted and governed in accordance with the laws of the United Mexican States, including the Federal Consumer Protection Law, the Federal Law on the Protection of Personal Data Held by Private Parties, and NOM-247-SE-2021 regarding e-commerce.

In the event of a dispute, the parties agree to seek resolution through conciliation before the Federal Consumer Attorney's Office (PROFECO) and, if an agreement is not reached, they submit to the jurisdiction of the competent courts of Mexico City.
